Lesser tyrants emboldened by a lawless POTUS

Last week it was rewriting our immigration laws (not that any of them are enforced anyway) to allow Islamists – make that, asylum seekers with loose or incidental ties to terror and insurgent groups into the country. So now we’re officially inviting in more folks like those nice Tsarnaev brothers.
 
This week, NerObama is yet again altering his signature legislation with that ubiquitous pen (I believe this is at least 17 times now – but who’s counting), conveniently postponing more of those unhealthy coverage deadlines until after the midterm elections.
 
Obama’s imperial proclamations are being delivered with growing frequency (not to mention arrogance). But since the only people outraged by these stunning abuses of authority are we constitutional conservative types – and who cares what we have to say – other like-minded statists are increasingly following the president’s lead with impunity.

 

Virgina ~

Much like the Obama administration arbitrarily decided not to defend DOMA (Defense of Marriage Act) five years ago, last month Virgina’s Attorney General Mark Herring decided he could ignore that state’s ban on same-sex marriage; just took it upon himself to declare that the law was unconstitutional.
 

Washington State ~

Today Governor Jay Inslee announced that he was suspending capital punishment in the Evergreen state ~

“… in death penalty cases, I’m not convinced equal justice is being served.”

 
The fact that making that particular determination doesn’t fall within his “pay grade” is apparently irrelevant.
(Ironically Inslee, as a Democrat, is a member of the political party that strongly supports abortion, condemning millions of unborn innocents to death simply because they’re inconvenient.)
 

New York City ~

Before his term is up, Mayor de Blasio may wind up in a category all his own. Since taking charge of the Big Apple ~
 
• He declared that he would be banning the city’s iconic horse-drawn carriages (even though over 60% of New Yorkers are opposed)
 
• He arbitrarily eliminated law enforcement’s Stop and Frisk practice. He simply decided that the policy was racist – never mind that it was an effective crime prevention tool; 33% Rise in NYC Murders Under Bill “Soft on Crime” de Blasio.
 
• And yesterday, in his state of the city address, de Blasio announced plans to give municipal ID’s to the city’s ( half million 😯 ) illegal aliens (But aren’t they illegal? Hey, let’s not get petty), and demanded that NY Governor Cuomo give him the power to raise the minimum wage.

Gowdy calls out president’s “smidgen” lie

In a taped interview with Fox’s Bill O’Reilly airing earlier this week, President Obama let loose with another one of his – what are becoming all too frequent – flagrant falsehoods. With regard to the admitted targeting of conservatives and tea party groups by the IRS, he dismissively repeated that “there have been multiple hearings,” and asserted that “not even a smidgen of corruption” has been found.
 
Well guess what Mr. Obama? Rep. Trey Gowdy (R-SC) begs to differ. Here he is yesterday at an Oversight and Government Reform Committee hearing, exposing the fact that there’s a whole lot more than a “smidgen” ~
 

 

The president says there’s not a ‘smidgen’ of criminality or corruption,” Gowdy said during a hearing of the House Oversight And Government Reform Committee on the IRS scandal.
 
Do either of you,” he said, addressing two Tea Party leaders who appeared to testify on their experiences with the IRS, “remember seeing a witness named Lois Lerner, sitting at the very table y’all are sitting at?
 
Do you remember her invoking her Fifth Amendment privilege? The same privilege that she targeted some of your groups for trying to educate people about?
 
Some of your groups just want to simply educate people about the Constitution — the one she availed herself of the very second she was exposed to criminal investigation.”
 
So how can the president say there’s not a ‘smidgen’ of criminality when Lois Lerner invoked the Fifth Amendment? Forty-one witnesses haven’t been interviewed, including the two who are here right now!” he added. “How can he possibly draw that conclusion?

More proof of the lie ~

Powerline blog posted a letter yesterday from courageous IRS whistleblower William Henck.
“Smidgen?” People, we’re talking boatloads of corruption! In fact, this rot in the IRS is indicative of the arrogance, bullying, and squandering of billions of our tax dollars, that’s become all too common with the O’Ministration.
 
Here are some excerpts from the letter ~

I do not personally know whether the IRS has targeted conservative groups or individuals, but I do know that the environment within the agency is ripe for such activity and there is nothing to prevent it from occurring. As stated in more detail below, I have personally witnessed improper giveaways of billions of dollars to taxpayers with inside access at the agency, bullying of elderly taxpayers, the cover-up of managerial embezzlement and misappropriation of thousands of dollars in government funds, and a retaliatory audit. I have also heard credible accounts of, among other things, further improper giveaways, blatant sexual harassment, and anti-Semitism. All of these matters have been swept under the rug.
 

I am reporting the information stated above because as a federal employee, I took an oath to the United States. I have a legal and moral obligation to report this information. I am proud of my colleagues in the IRS. The vast majority of us attempt to do our jobs in a conscientious manner. However, there is a culture of corruption within the IRS that dishonors that majority and the government we serve. Any organization will have its share of bad apples and misconduct. What separates the IRS is its junkyard dog ferocity in covering up misconduct. There is a strong cultural imperative within the IRS to protect the organization and high-ranking officials’ positions within it. If you report misconduct or dissent from the party line, your career is finished. Period. (For example, I still as of this moment have a job, but my career was finished as soon as I reported that manager for embezzlement.) […]

As stated above, I have no direct knowledge of harassment for political reasons. I fear, however, that the ordinary citizens recounting stories of IRS abuse due to their political beliefs are telling the truth. (It is naïve to think that IRS executives would engage in the activities described above, but somehow draw the line at politically motivated harassment.) If these taxpayer accounts are true, then the IRS executives are doing it for a very simple reason: because they can. There is no accountability for IRS misconduct and people within the agency are scared to speak out and also believe, with considerable justification, that such action would be futile.
 
I have chosen to speak out in part because I have personally experienced the horrific damage that bureaucratic bullies can inflict. I also have tried to live up to the admonition in Romans 12:21: do not be overcome by evil, but overcome evil with good. I could sit around and knock down Jim Beam and complain, or I could try to do something constructive about the situation. I chose the latter option.

Responding to what they perceive as “antagonism” against Israel from our illustrious Secretary of State, a group of rabbis from the Committee to Save the Land and People of Israel sent John Kerry a “Wrath of God” letter ~

… the criticisms in the letter stem from Kerry’s efforts to “hand over” Israel to Palestinian Authority Chairman Mahmoud Abbas as well as his threatened global boycott of the Jewish state if peace talks fail. The letter contends that Kerry’s plans would result in tens of thousands of Jews being displaced from their homes, something the rabbis equate to “war on God.”

A “Supreme” Shame

It’s been almost a decade since the United States Supreme Court decided that the city of New London, Connecticut was well within its rights to force private citizens to relinquish their property for – what basically amounted to – the good of the collective. Unbelievably, the once-disputed property is still vacant. Worse – it’s a blight. As National Review Online reports, Nine Years after Kelo, the Seized Land Is Empty ~

Fort Trumbull in New London, Conn., was bulldozed to fulfill the vision of politicians and developers eager to create a New Urbanist mixed-use “hub” for upscale living in the depressed town near the mouth of Long Island Sound.
 
(Now), the land is nothing but vacant urban prairie. After homeowners were forced off their property for the sake of “economic development,” the city’s original development deal fell apart, and the urban-renewal corporation that ordered the destruction has not found a developer to use the land.

 
In Kelo v. City of New London seven property owners – including Susette Kelo, owner of the “Pink House” – fought the eminent domain filings all the way to the Supreme Court.
 
kelohouse2The justices’ 5:4 ruling affirmed that government may forcibly transfer property from one private owner to another if the government believes the latter will generate greater economic activity.
 
This, boys and girls, is what’s known as judicial activism.
 
 
As Heritage Foundation explains, judicial activism occurs when judges write subjective policy preferences into the law rather than apply the law impartially according to its original meaning.

In their analysis, the Kelo case was clearly activist because ~

… the court strained the plain text of the Constitution to achieve their apparent desired ends, bending terms to the point of breaking. The Takings Clause in the Fifth Amendment was enacted to prevent the government from infringing on the private property rights of citizens, a right which was fundamental to the American Founding. Thus the words “public use” limited the government’s power to the taking of private property only when the land desired would be used by the general public. Roads, schools, or libraries would be permissible grounds for public takings under this original understanding.
 
The Court abused precedent, reinforcing grave errors by extending the misinterpretation of “public use” as being the equivalent of “public purpose,” which not only displaces the language of the Clause, but invites limitless infringement on one of our most fundamental rights. As Justice O’Connor states powerfully in her dissent, “Under the banner of economic development, all private property is now vulnerable to being taken and transferred to another private owner, so long as it might be upgraded—i.e., given to an owner who will use it in a way that the legislature deems more beneficial to the public—in the process.”

So, other than to illustrate the post-Constitutional nature of present-day America, was this whole episode was for naught?
Not necessarily.
Two years ago New London actually did stumble upon a good use for the 91 acres of misbegotten land ~ Kelo Aftermath — The Final Indignity ~

Now, we learn from the local newspaper (August 2011), The Day, that following Hurricane Irene, the city has designated the Fort Trumbull redevelopment site as a place to dump vegetation debris.

Seriously, this lesson in BIG Government overreach served as a wake-up call for liberty-loving Americans across the country; inspiring many to shore-up private property rights legislation in their local communities to avoid similar shameful episodes.
 
And happily, the “Pink House” actually got a new lease on life ~

In June 2008 Susette Kelo’s house was moved to a new site on Franklin Street. The dedication plaque out front reads as follows ~

This little pink house was the subject of the landmark 2005 U.S. Supreme Court case Kelo v. City of New London, one of the most widely despised decisions in the Court’s history. In Kelo, the Court ruled that New London could take this home and others and give the land to a private developer in the name of “economic development.”
 
The case caused a nationwide backlash against eminent domain abuse, resulting in reform legislation in more than 40 states and numerous state court decisions in favor of property owners. It also inspired citizen activism to protect property rights from takings for private development.
 
This house, moved from the Fort Trumbull neighborhood, stands as a testament to the bravery of Susette Kelo and her neighbors, and to the thousands of others who have battled and are battling the abuse of eminent domain across the country.

Obama’s Extra-Constitutional Pen

Senator Mike Lee (R-UT) was probably recalling that little dictatorial proclamation from the chief executive when he was questioning the attorney general last Wednesday ~

Sen. Lee’s line of questioning was initially in the context of the government’s collection of metadata and the risk of abuse that’s inherent in that activity. He was attempting to learn from Holder how and when the attorney general had determined that the president’s actions were within the limits of his constitutional authority, [Justice Department’s Office of Legal Counsel (OLC) is required to review executive orders by the president to ensure they do not violate the Constitution] particularly with regard to,
 
1. delaying the enforcement of the employer mandate for Obamacare, and;
 
2. raising the minimum wage (as he had just proposed the night before during the State of the Union Address).
 
The response was mostly legal-sounding blather, the gist of which was that apparently Obama’s imperial prerogative is just an inherent power. Holder was unwilling or unable to cite specific authority- because there isn’t any.
 
Lee wasn’t amused by the attorney general’s obfuscation ~

“It’s one of the reasons why we have a Constitution, is to protect us against the excessive accumulation of power.”
 
(Looking at the “nature” of Obama’s use of executive orders, it is clear the president has) “usurped an extraordinary amount of authority within the executive branch.”

We can presume that Commrade Lenin, a stickler for “strictly revolutionary order,” who demanded the “merciless suppression of attempts at anarchy on the part of drunkards, hooligans, counterrevolutionaries and other persons” would not have been amused.

The effect of releasing this information – which could only have emerged from a government database – was incendiary in the literal sense. Cars belonging to protesters have been set ablaze in the middle of the night, with perhaps 200 receiving this treatment so far.
